Maryland Probate Lawyer: What Happens to Unclaimed Gifts?

www.reichertlegal.comIf a legatee hasn’t claimed a gift, that they were entitled to, under a modified estate in Maryland, does the asset get distributed to other named heirs?

The first place to look for the answer is to the decedent’s Maryland Last Will and Testament. In Maryland the Personal Representative (known as an Executor in other states) is required, and has the duty, to distribute the estate assets per the Will. If the legatee does not respond, the Personal Representative should speak with a probate attorney as to reasonable next steps to get the asset distributed to the legatee. If this is unsuccessful probate will then allow the Personal Representative to distribute the asset to the person next entitled to receive the gift.
