Ellicott City, Maryland Estate Planning Lawyer: Where to File a Will in Ellicott, Md. & Howard County

Howard County CourthouseMaryland, unlike many states, allows Wills to be filed with the county in which you live. As an estate planning attorney, I have encountered clients in Maryland who have failed (or their attorney failed) to file their Will with the county. This is a critical final step in the Will creation process as it ensures safe keeping and quick access to your Will by the court that will handle probate for your estate. Filing of Wills is a service that I provide for all of my clients.


Ellicott City & Howard County Residents

If, like many of my clients, you live in Ellicott City, or anywhere in Howard County, you should file your Will with the Register of Wills. If you haven’t done so you should submit your Will as follows:

1. Seal your Will in an envelope
2. On the outside of the envelope write your name, address, social security number, date of the Will, and the name of your Personal Representative
3. Place this envelope along with $5 payable to “Register of Wills, Howard County” inside a larger envelope
4. Mail to: Register of Wills, Hon. Byron E. Macfarlane, Circuit Courthouse, 8360 Court Ave., Ellicott City, MD 21043


Updating Your Will

If your Will is several years old or you have experienced any life-changing events since your Will was created, such as marriage, divorce, the birth or death of a child, a child who is no longer a minor, a child who has since gotten married, a change in residence, or the death of anyone named in your Will, including Personal Representatives or back-up Personal Representatives, you should have your Will reviewed and updated.
