Maryland Property Law Attorney: What Happens When Your Name Is On The Mortgage But Not On The Property Deed?

Deed_Drafting_Recording_Maryland_AttorneyA common question from clients involves the above listed scenario where your name is on the mortgage for the property as a borrower however your name is not listed the real property title (Deed). This concern often arises after a divorce or death in the family.

Unfortunately in this instance you have no interest in the property itself, as the only way to have this interest is to be listed on the recorded property Deed that is filed with land records in your county. You do however have an ongoing obligation to pay the mortgage (or in some instances a percentage of the mortgage) for the property.

If this presents a problem for you, there are legal solutions, such as having your name added to the Deed or negotiating a sale or refinance with interested parties.

To discuss this and other property concerns and laws in Maryland, call or e-mail for a free confidential consultation: Maryland attorney Stephen J. Reichert at 410-299-4959, sreichert@reichertlegal.com or by clicking here.
