Final Step in Forming a Maryland S Corporation
Once your company has been formed under the laws of Maryland there is one additional filing requirement that needs to be made with the IRS. Your S-Corporation Election must be completed and filed with the IRS within 75 days of the date the corporation was formed in Maryland. If your designation is not filed by this deadline the S-Corporation federal tax status will not go into effect until the next calendar year. Form 2553 is used to make the S-Corp Election with the IRS. Some states (Arizona, New York, New Jersey and Ohio) have a state level S-Corporation status however Maryland does not and filing with the IRS it the only way to obtain this status.
